The civilians of Gaza have lived under occupation and systematic violations of international human rights laws for over 40 years
The reality of life in the Gaza Strip is hard to convey. Individuals throughout the world have seen the pictures and the images: shootings and maiming, air strikes and artillery shelling, and the unforgettably horrific sight of white phosphorous raining down over Gaza city. However, beneath these images lies a complex reality.
The civilians of Gaza have lived under occupation for over 40 years. They have been collectively punished since June 15, 2007, cut off from the outside world for almost 1,300 consecutive days. Systematic violations of international human rights law have created abject poverty, and reduced approximately 1.7 million people to 'beneficiaries' of international aid, forced into dependency as the result of a human-made, and completely preventable, humanitarian crisis.
International human rights law and international humanitarian law offer necessary protections to every individual on the basis of their shared humanity. However, if they are to have meaning, these laws must be enforced.
This is a core component: in the event of a violation, accountability and judicial remedy are the essential consequences. Customary international law, binding on all States, recognizes that this accountability should take the form of criminal accountability, through investigations and prosecutions, and civil accountability, through the payment of compensation.
It is this right to compensation that the Palestinian Centre for Human Rights is fighting for today. In the current climate, given the bias inherent in the Israeli judicial system, compensation is one of the only hopes for achieving some form of justice. Importantly, this compensation – although insignificant in comparison to the loss suffered – is essential for victims as they attempt to rebuild their lives and their homes. This right is being comprehensively denied by the Israeli authorities.
Israel imposes a 2 year statute of limitation on the submission of civil complaints. Given the scale of violations committed in the context of the 22-day offensive on the Gaza Strip alone, this places an often insurmountable burden on the legal representatives of the victims. Until the second intifada, the statue of limitations was 7 years.
Second, and in a requirement that places the final nail in the coffin with respect to the right to a remedy, the court imposes an insurance (or guarantee) fee on each claimant, before a case can proceed. There is no fixed amount for this insurance fee, it is set at the discretion of the court. However, it represents a significant financial hurdle, typically in excess of 10,000 shekels (around $2,800), and often much more.
In one case brought by PCHR, the claimants were asked to pay 20,000 shekels for each of the five deaths reported. This raises the bizarre, but all too real, scenario whereby the greater the violation, the greater the financial hurdle.
Palestinian victims are simply unable to raise this money, and the case is closed firmly in their faces. This insurance fee is completely discretionary. It is not mandatory. In practice, it is always applied to Palestinian claimants.
On top of this is the reality of the closure. PCHR's lawyers cannot travel to Israel to represent our clients, and we are forced to hire lawyers in Israel. However, these lawyers cannot come to Gaza to meet the clients, and the clients cannot go to Israel to meet them. In addition, since June 2007, the Israeli military has refused permission to Palestinians involved in civil cases to appear in court, despite the issuance of a court order. This results in the effective dismissal of the cases, and the absolute denial of justice.
PCHR represents over 1,000 victims of Operation Cast Lead. The approximately 500 cases prepared on their behalf constitute the overwhelming majority of cases prepared following Operation Cast Lead. These individuals, who have suffered virtually the entire spectrum of rights violations – from illegal killing and injury, to the illegal destruction of their homes and workplaces – have the right to justice. They deserve to be heard by a court.
Since March 2009, when the last notice to the Ministry of Defense was submitted, we have been systematically ignored. Despite repeated requests, PCHR has only received interlocutory responses – with no information – with respect to 23 cases.
On December 20, PCHR and attorney Michael Sfard, filed a petition before the Israeli High Court of Justice, demanding that these victims rights to a judicial remedy be upheld. Our request is simple, that the statute of limitations be delayed, that the victims of Operation Cast Lead are at least afforded the opportunity to take their case to court.
If the court rejects this position, it will be closing the door to justice on all the victims of Operation Cast Lead.
The rule of law is something we respect and hold dear. But it is a self evident truth that in order to be relevant, the law must be enforced. The absence of justice has resulted in the dire situation we face today, in the systematic violation of fundamental human rights, and the closure of the Gaza Strip. Without justice, what is there to prevent what happened in Gaza from happening again?
Behind the closed doors of the Gaza Strip, it is our shared humanity that continues to link us to the outside world. We demand that our human rights be respected and protected. We demand that the international community stay silent no longer, that it exerts its influence in the name of fundamental freedoms and justice.

A day earlier, the PA cabinet condemned what it called "Israeli attacks on Palestinians and their property," saying that within the past week, in addition to the land confiscation in the southern West Bank, 40 dunums in Nablus had been appropriated by the Israeli military, and dozens of trees had been taken down as the construction of the separation wall continues in Walajeh.

UN envoys criticize Israel home demolitions
24/12/2010, JERUSALEM (AFP) -- Two United Nations representatives have criticized Israel for demolishing Palestinian homes in occupied East Jerusalem, with a senior envoy saying the actions could violate international law.
On Thursday, a field worker for the UN Relief and Works Agency, which cares for Palestinian refugees, decried the "trauma and indignity" of two home demolitions in East Jerusalem. "These condemnable acts have a devastating impact," Barbara Shenstone said in a statement.
She said the two families affected opted to destroy their own homes rather than wait for Jerusalem municipality to do so because a municipal demolition would cost them up to 120,000 shekels ($33,389).
"While children around the world are enjoying the holiday season in their homes, these children have suffered the trauma and indignity of watching their homes destroyed in the presence of their parents. It is extremely cruel and distressing."
A day earlier, Maxwell Gaylard, the UN humanitarian coordinator for the occupied Palestinian territory, offered his own condemnation after visiting the site of a home that had been demolished 24 hours earlier.
"The destruction of this home and the displacement of these people raises serious concerns with regard to Israel's obligations under international law," he said. "These actions have a severe social and economic impact on the lives and welfare of Palestinians and increase their dependence on humanitarian assistance," he added.
"The government of Israel must take immediate steps to cease demolitions and evictions in the West Bank, including east Jerusalem."
Israel says it demolishes only homes that have been built without a permit, but Palestinians say it is virtually impossible to secure Israeli permission to build in East Jerusalem.

That figure was up from 275 the previous year, and left 561 people including 280 children without a home, the agency said.

Zahhar: Hamas still committed to truce

Environmental disaster in the in Persian Gulf
The contaminated waterway has caused catastrophic and adverse environmental impact with major consequences. Vital resources including environmental sensitive areas along the Persian Gulf shores have been destroyed.
Persian Gulf, a key waterway for region's oil exports is heavily contaminated. Many oil spills, industrial wastes and chemicals that are regularly being dumped in the waterway or at its shores are rapidly poisoning and contaminating the entire Persian Gulf.
Oil-related activities, regular sewage release, heavy shipping navigation, the presence of military fleets and submarines -- and that pollution is killing or poisoning wildlife, including fish presumably destined for human consumption with adverse consequences on human health and livelihood. Many of local populations of corals and fishes have been destroyed in recent years.
Persian Gulf is 47 times more polluted than what is described as the "standard level." During the Persian Gulf War, Saddam Hussein deliberately released over 500 million gallons of crude oil into the Persian Gulf from tankers 10 mi off Kuwait. Spill had little military significance but caused a major environmental disaster in the area. On Feb. 2007, Norooz oil field platform spilled 80 million gallons of oil in Persian Gulf. On July 15, 2008 oil sludge containing oil byproducts seeped out of damaged containers. A month later 79 dolphins washed ashore near the smaller port of Jask. High levels of pollution and an oil spill are being blamed for the recent deaths of dolphins and whales off Iran's Hormozegan Province, on the Persian Gulf.

Sri Lanka Army active in grabbing strategic lands in North
TamilNet, Sri Lanka Army (SLA) authorities in Ki’linochchi have threatened 18 Tamil families in Irathinapuram where they were each given 5 acres of land to live in 1994 by Sri Lanka government for which they have the documents proving ownership. SLA now claims that a Sinhala school had been located in the said area and therefore the land belongs to the government. SLA further says that it wants the land to be used as cattle grazing ground, the families said.
Similarly, SLA officials in the Achchuveali camp have claimed areas in Puththoor and Vaatharavaththai in Valikaamam East saying that a Sinhala school called Panjaseeva and a Buddhist temple had been functioning in the said area.
A military establishment and Sinhala colony at strategic Vaatharavaththai will check free movement of Tamils among the sectors of Valikaamam, Vadamaraadchi and Thenmaraadchi regions of the Jaffna peninsula. The officials have also put up notices in some of the above lands identified as government property informing that they had been reserved for SLA use, local residents said.
Sri Lanka government is using SLA to grab lands in the North with the view of colonizing them with Buddhist Sinhala families, civil society circles in Jaffna said.
The eighteen Tamil families in Irathinapuram find themselves in a desperate situation being threatened by SLA to vacate their lands where they had owned and lived since 1994.
Meanwhile, SLA men are attempting to remove a Vairavar Temple erected by the Saiva people in Puththoor and Vaatharavaththai areas. Heavy vehicles are being used day and night to clear the lands in Puththoor and Vaatharavaththai areas claimed by the SLA as government lands, local residents said.
A few months ago, a Sinhala sociologist, Dr Susantha Goonatilake visited Puththoor andn told the local people that the village had been Sinhala-Buddhist in the historical past. Dr. Goonatilake is closely connected to some Sinhala ministers of Colombo. During the war he expressed opinion that military families should be settled in the ‘conquered’ land. Many Sinhalese consider him insane in his views, but those are ones chosen by Colombo for implementation.

UN has 'serious concerns' over home demolitions
22/12/2010, JERUSALEM (Ma'an) -- The UN's Humanitarian Coordinator in Jerusalem told reporters Wednesday that the displacement of a Jerusalem family whose home was demolished the day before "raises serious concerns with regard to Israel’s obligations under international law.”
The UN's Maxwell Gaylard, issued a statement after visiting the family of 13 whose home in the Ras Al Amud neighborhood of East Jerusalem was torn down on Tuesday by order of the municipality of Jerusalem, under the Israeli government.
The past week has seen two other home demolitions in East Jerusalem, in the neighborhood of Sur Baher and the village of Nu'man. Addressing what other UN officials called a "sharp increase" in home demolitions during the week, a monitors report recorded the demolitions in Jerusalem and another 43 in areas of the West Bank.
The statement from the UN office said the incidents "are a manifestation of the increase in such demolitions in 2010," during which 396 Palestinian structures were demolished in East Jerusalem and other areas under full Israeli control in the West Bank. This compares to 275 in the previous year – an increase of almost 45 %. As a result this year, 561 people have been displaced, including 280 children, and the livelihoods of over 3,000 people have also been affected.
“These actions have a severe social and economic impact on the lives and welfare of Palestinians and increase their dependence on humanitarian assistance. The position of the United Nations remains that the Government of Israel must take immediate steps to cease demolitions and evictions in the West Bank, including East Jerusalem,” Gaylard said.

Bill Van Esveld, the author of the report and a researcher at HRW's Middle East division, said the study exposed a two-tier system enforced by a network of discriminatory laws and military orders. "We're talking about different treatment of two people living in the same area for no real reason," he told AFP.

The UN's Maxwell Gaylard, issued a statement after visiting the family of 13 whose home in the Ras Al Amud neighborhood of East Jerusalem was torn down on Tuesday by order of the municipality of Jerusalem, under the Israeli government.
The past week has seen two other home demolitions in East Jerusalem, in the neighborhood of Sur Baher and the village of Nu'man. Addressing what other UN officials called a "sharp increase" in home demolitions during the week, a monitors report recorded the demolitions in Jerusalem and another 43 in areas of the West Bank.
The statement from the UN office said the incidents "are a manifestation of the increase in such demolitions in 2010," during which 396 Palestinian structures were demolished in East Jerusalem and other areas under full Israeli control in the West Bank. This compares to 275 in the previous year – an increase of almost 45 %. As a result this year, 561 people have been displaced, including 280 children, and the livelihoods of over 3,000 people have also been affected.
“These actions have a severe social and economic impact on the lives and welfare of Palestinians and increase their dependence on humanitarian assistance. The position of the United Nations remains that the Government of Israel must take immediate steps to cease demolitions and evictions in the West Bank, including East Jerusalem,” Gaylard said.

UK backed Israeli deal to enhance Lanka`s firepower
December 2006, The controversy over the alleged irregularities in a multi-million US dollar deal, to upgrade the firepower of Fast Attack Craft (FACs), has taken a shocking turn with the revelation that the British Government assured Sri Lanka that the transaction was above board.
Britain also offered the Sri Lankan government an opportunity to inspect the 30 mm KCB cannons at a US government bonded store in St. Louis. The British High Commission made representations on behalf of the British supplier S.G.E. Limited to facilitate the deal worked out by Rafael Armament and Development Authority Limited of Israel.
The UK based supplier specialises in the supply of naval equipment, tools and services. Rafael won the contract worth US $ 10.8 million in December 2003 to upgrade 15 FACs. The Israeli and the British firms, according to documents submitted to the Tilakawardena Committee, had worked closely for two years on this particular deal. In an unprecedented move both the supplier and the British High Commission made representations to the three-member Presidential Commission headed by Justice Shiranee Tilakawardane.
They challenged the cancellation of the order on the basis that the S.G.E. Limited and Rafael planned to supply 20-year-old guns discarded by the Royal Navy. The British emphasised that the guns manufactured in 1985 and kept at St. Louis were new. The British assured that none of the guns had been used or refurbished while reiterating that the long-term storage of the KCB material had been done according to internationally accepted standards.
An authoritative British High Commission spokesperson confirmed the action taken by the mission to facilitate the deal. The former British High Commissioner Stephen Evans had apprised Defence Secretary Colonel (retd) Gotabhaya Rajapakse earlier of the transaction.
The British offered to arrange an expert to inspect the guns at St. Louis or sent a complete 30mm KCB cannon set to Colombo at no cost to Sri Lanka. The SLN initiated an ambitious project in 2001 to upgrade the firepower of its FACs. The cutting edge of the SLN is its FAC squadrons based in Trincomalee. The SLN planned to replace the existing 23 mm cannons with 30mm.
The project did not materialise due to a variety of reasons, particularly the differences among the UNF bigwigs over the deal with some of them resolutely calling for the acquisition of US built Bush Master Cannon (MK 44). The FACs are equipped with Israeli-built Typhoon Weapon Stations. The British Government also assured Sri Lanka that the 30mm cannon and its ammunition remain in production. The British reiterated their faith in the weapon by revealing that over five dozen units would remain in service and that the same weapon had been chosen for deployment with a new destroyer scheduled to join the British naval forces in about three years. Although two dozen units are to be replaced, the British navy would continue with the system deployed on the remaining vessels.
The British High Commission said that Sri Lanka cancelled the deal after the Government approved the sale. Former Navy Chief and Chief of Defence Staff Admiral Daya Sandagiri gave the go ahead for the Rafael deal on the recommendation of a three-member committee chaired by the then Chief of Staff Vice Admiral Mohan Wijewickrema. The recently retired Vice Admiral Sarath Weerasekara had been also on the committee. The Presidential Commission summoned both officers along with Sandagiri. The British indicated that they would appreciate if the Tilakawardena committee recommended the inspection of the cannon in the US or bringing down a complete set to Colombo for the same purpose. The Island learns that S.G.E. Limited offered to supply the cannon directly to Sri Lanka after the cancellation of the original order with Rafael.

Israel has multi-million dollar contracts in selling and maintaining the Israeli designed and built Kfir Jets. Israel has been contracted by Sri Lankan Air Force to send their technical specialists to assist in the maintenance of the Russian built MIG-29 jets. Besides the technical support given, at Sri Lanka's request - Israel had even sent their military advisers to give "technical advise" in electronic intelligence, military tactics and strategies in the field.
Israeli and Sri Lankan military co-operation has existed since 1984.(!) As a result of a trade agreement between Colombia and Israel in 1989 the Colombian government bought a batch of twelve ex-IAF Kfir C.2s and one TC.2, which were delivered to the Colombian Air Force (FAC) in 1989-1990.
Since then, all the C.2s have been upgraded to the C.7 variant. The FAC Kfirs have been widely used in ground-attacks. In February 2008 Colombia signed a deal with the Israeli government for more 24 ex-IAF Kfir aircraft. These aircraft will most probably be upgraded by Israel Aerospace Industries to C.10 standard. The Sri Lankan air force has acquired several modern jet fighters from Israel as the military continues to build up.
While the EU has criticised the violence in Sri Lanka, some states continue to arm the government they are condemning. The EU calls for the alleged violations of these laws to be investigated through an independent inquiry," the statement continued. "Those accountable must be brought to justice." A number of EU member states - including Bulgaria, the Czech Republic, Slovakia, the UK, France, Italy, Lithuania, the Netherlands and Poland - have however continuined to arm the Sri Lankan government since the election of hardline president Mahinda Rajapaksa in 2005.
According to the EU's latest report on arms export licences published in December, the nine governments authorised arm sales licences to Sri Lanka to the value of €4.09 million in 2007, the same year that Colombo launched its final offensive on LTTE. The licensed material ranges from small weapons, ammunition and explosives to missiles, ground vehicles, naval vessels and aircraft, with the eastern European member states mainly supplying small arms, while western member states sell the bigger hardware.
The EU report is compiled annually to ensure that European countries comply with the EU's Code of Conduct on Arms Exports, which is not legally-binding but which sets an ethical benchmark for the EU club. According to the code, members states should "not issue an export licence if there is a clear risk that the proposed export might be used for internal repression." The value of delivered EU shipments in 2007 is lower than the €4 million figure, coming in at €1.16 million, but the remainder may still have been shipped since or will be at some point in the future. The bulk of Sri Lanka's weapons shipments do not come from the EU, with Colombo preferring to access its armaments from countries with lower prices. EU-origin arms sales to the south Asian country pale in comparison to those from Ukraine and Iran.
In 2007, Ukraine sold four Mig-27s to Colombo for €7.2 million ($9.8m). Iran agreed to an arms deal worth up to €104 million ($140.9m), including missile systems for the Sri Lankan air force, navy patrol boats and a small arms ammunition plant, according to Jane's Defence Weekly. China has been Sri Lanka's biggest arms supplier since the 1990s. In 2007, China sold €27.8 million ($37.6m) of ammunition and in 2008 lent Colombo six F7 jet fighters in 2008.

Collaboration of police and ultra-nationalists against Kurdish students in Aydın
17.12.2010 AYDIN (DIHA) -Kurdish students from Adnan Menderes University (ADÜ) in Aydın applied to the Human Rights Association (IHD) Aydın Branch to request legal aid to defend themselves from the collaboration of police and ultra-nationalists against them.
According to the students, police and ultra-nationalists' antagonism of Kurdish students has made life on-campus stressful. Kurdish students argue that the nationalists are able to conduct raids on student dorms and demand to see their identification cards to determine if they are Kurds or not. Following the raids, students from the right-wing attack Kurdish student individually and threaten them. Students claim that the nationalists are supported by the police.

"Pakistan is providing intelligence, location and the identity of the hit list and then the US destroys these targets with drone attacks."
It is an undeniable fact that most of the Taliban leaders are living in Pakistan under ISI protection. Why are Taliban leaders in Pakistan? Following the collapse of the Taliban regime in Kabul in 2001, the ISI managed to beguile the key Taliban leaders and their families to find shelter in Pakistan. This was part of Pakistan’s strategy to have the Taliban leadership under its control in order to retain the greatest capacity to influence Afghan internal politics. The Taliban one-eyed leader, Mullah Omar is now virtually a prisoner to the ISI and has no ability to act on his own.
“Do you really think the ISI could pick Mullah Omar if they wanted?” Hillary Clinton asked President Hamid Karzai in Kabul. “They could deliver Mullah Omar like I can pick up this cookie." Karzai answered when he reached over and plucked a chocolate chip cookie from his plate,” reports Bob Woodward in his book Obama’s War.
The former Taliban Ambassador to Pakistan Mullah Salam Zaeef who is living in Kabul said recently that there are about 2,500 Taliban in Pakistani sepulchral prisons across the country. They are kept for future use in Afghanistan. Last year when I spent time in Kabul, a young journalist from Paktia province, which borders Pakistan, threw his hands in the air and cried out at a conference, “I swear to Allah that Taliban still receive instructions from the ISI.”
The ISI, likewise, detained 23 Taliban leaders, including Taliban second-in-command Mullah Ghani Brader in February who was in secret talks with Karzai without Pakistan being aware of this. Pakistan’s drumbeat of claims that every peace effort in Afghanistan will doom to failure without Pakistan’s participation self-evidently explains the ISI enormous leverage on the Taliban.
The US is now hoping that Pakistan will launch a military offensive against the Haqqani network in north Waziristan. As reports indicate the ISI has already begun relocating Haqqani network. The Pakistani military might launch a few mock operations in north Waziristan as decoys to ensure the flow of the American cashout. This is Pakistani opus operandi, as Stephen P. Cohen writes in The Idea of Pakistan, “Pakistan’s officials like Pakistani beggars, become alert when they see Americans approaching.”
To make sense of the secrecy behind the US-Pakistan relationship, every commentator is marching on a slippery slop. Has the US leadership become schizophrenic by throwing borrowed money from China and elsewhere at a country that is helping its enemies in Afghanistan to kill more Americans? Nearly 600 coalition forces, including 400 Americans, have so far been killed this year in Afghanistan.
